Approval of Family Violence Green Card (I-360), No Silence of Domestic Violence

We will share a successful case of family violence green card.

The client married with a US citizen, and they have submitted marriage based green card application. Before the interview, the marriage turned bad. The US citizen spouse refused to go to the interview with the client. Under the help from Sabrina Li, the client submitted the green card application based on domestic violence. After 2 years, it is approved. 

Their marriage was not problematic from the first beginning. Rather, the unhappiness is accumulated, from disputes to threats. Every time when the client complained, the US citizen husband threatened her by her green card application. The client had to compromise. However, this tolerance did not make the relationship better. The husband even began to beat her and found a mistress. The client also did not report to the police because she worried she could not prove the fact of family violence just by her own statement. 

Family violence green card applicants must show they have eligibility, including:
  • Bona fide marriage
  • Living together with the abusive spouse
  • Good moral character of the applicant
  • Being beat and abused, or other extreme cruelties

Many victims of family violence dare not report to the police, which causes continuous abuse. In fact, victims in family violence should protect their rights by finding a lawyer to get their legal immigration status.
