I-601 granted for misrepresentation made association with FINDREAM

Another victim of Findream has been successfully assisted by the Law Offices of Sabrina Li!

After her spouse was granted an I-140, our client filed an application for adjustment of status as a derivative beneficiary on her own. Nearly a year later, our client received a Notice of Intent to Deny (“NOID”) from USCIS. USCIS intended to deny her application for adjustment of status because she had listed Findream as an employer on a previous application to change her status.

The founder of Findream, Findream itself, and other affiliated organizations, were directly tied to visa fraud in assisting individuals to obtain or maintain F-1 student visas and H-1B visas.

Because our client had previously listed Findream as a former employer, USCIS believed she was inadmissible under INA § 212(a)(6)(C)(i) for willfully misrepresenting her employment history to maintain her status and then change her status. USCIS gave the client a short deadline to submit a response to try to avoid her application for adjustment of status from being denied.

The client contacted us and asked us to help respond to the NOID. She was desperate as she had been living lawfully in the United States for ten years and had much to lose. Her husband was a green card holder, she had two young children who were United States citizens, and was pregnant with a third. If she were unable to obtain her green card, she would have been forced to separate from her entire family.

Our expertise with the Findream situation allowed us to quickly assess that the client was eligible for a waiver. We diligently and quickly went to work with assembling the client’s waiver, showing that our client deserved to stay in the United States with her family due to all of the positive factors in her case.

Due to our hard work and dedication, our client’s waiver was approved and our client’s adjustment of status was granted. She was able to obtain her legal permanent residence (green card) and remain happily in the United States with her family.

If you or someone you know has been previously associated with Findream or any of its associate companies, and fear encountering a similar issue, please do not hesitate to contact us.
