Successful EB2/National Interest Waiver Petition for Business  Owner

We will share a successful EB2/NIW petition that our attorney, Chadwick Gaines has handled. The case was submitted on behalf of a business owner who wanted to start barista training schools for individuals with disabilities in the United States. His client, a Korean business owner, had a school in Korea that focused on training individuals with disabilities to become baristas. These individuals otherwise lacked meaningful employment opportunities.

Before Mr. Gaines received the approval, he received a request for evidence (RFE). In response to the RFE, he submitted a developed and comprehensive business plan with financials. Additionally, he submitted evidence to show that this client had interested investors in the United States, as well as a sizable saving to self-invest in his business. Therefore, he were able to show that this client was well positioned to advance his endeavor in the United States.

Furthermore, we prevailed in showing the United States government that his client's proposed endeavor would benefit the National Interest of the United States, because his endeavor would train and employ Americans with disabilities - those who are otherwise unemployable or under employed. As a result, his client was able to secure a green card without an employer sponsor. However, this was not an easy task. Having a knowledgeable attorney is paramount to submitting a detailed and comprehensive petition to the United States government.
