NOID due to FINDREAM fraud, our assistance leads to approval

​Another victim of Findream has been successfully assisted by the Law Offices of Sabrina Li!  

Our client had used a different firm to file an application seeking to renew his H-1B status, but USCIS issued a Notice of Intent to Deny (NOID) his H-1B because our client had previously listed Findream as his employer during his STEM OPT. Because the H-1B is filed by the employer, our client did not have a choice in his prior attorney. However, when he received the NOID, he was very anxious that all his future potential immigration possibilities could be in jeopardy. Our client was worried because the attorney hired by his employer was looking out for the employer’s best interests, not his.  

He was especially concerned because the NOID charged our client with being inadmissible under INA 212(a)(6)(C)(i) for fraud/material misrepresentation. This allegation was because the founder of Findream, Findream itself, and other affiliated organizations, were directly tied to visa fraud in assisting individuals to obtain or maintain F-1 student visas and H-1B visas.  

The client contacted us and asked us to help him respond to the NOID. While the petition remained his employer, he wanted our knowledge and diligence in focusing on his best interests. While we could not take over his case, we provided him with a specialized service to compile and review his evidence with extra care, while maintaining our client’s confidentiality.  

Our expertise with the Findream situation allowed us to quickly assist the client in his response to the NOID. We knew it was crucial to avoid an inadmissibility finding under INA 212(a)(6)(C)(i) to avoid the applicant having to file a waiver, which he did not qualify for.  

We assisted him in drafting a timeline and declarations, collecting evidence, and recommending appropriate evidence from his school DSO. We worked directly with the client at all times to maintain utmost care and privileged communications. With our joint efforts, the client was able to avoid a finding of inadmissibility, and his H-1B renewal was approved.
